Legal agreement governing your use of ServMedica
PLEASE READ THESE TERMS CAREFULLY. By accessing or using ServMedica's services, you agree to be bound by these Terms of Service. If you do not agree, you must not access or use our services. These terms contain important provisions including limitations of liability, mandatory arbitration, and class action waiver.
Your acceptance of these terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ServMedica Inc. ("ServMedica," "Company," "we," "us," or "our") governing your access to and use of the ServMedica telemedicine platform, including all related websites, mobile applications, and services (collectively, the "Services").
By creating an account, accessing our platform, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are using the Services on behalf of a minor, you represent that you are the parent or legal guardian with authority to bind the minor to these Terms, and you accept full responsibility for the minor's use of the Services.
Who may use our services
What ServMedica provides
ServMedica connects travelers with locally licensed physicians in the country where the patient is physically located. Physicians may only treat patients in countries where they hold a valid medical license.
Services are designed for acute, non-emergency conditions common to travelers. Complex, chronic, or ongoing conditions should be managed by your primary healthcare provider in your home country.
Essential information about our service limitations
ServMedica is NOT for emergencies. Call local emergency services (911 equivalent) for life-threatening conditions.
ServMedica is NOT health insurance and does not replace comprehensive healthcare coverage.
Services supplement, not replace, your regular healthcare provider and ongoing medical relationships.
Physicians may decline treatment, referrals, or prescriptions at their professional discretion.
Your responsibilities when using our services
Actions that violate these terms
Violation of these prohibitions may result in immediate termination of your account, forfeiture of any prepaid fees, and potential legal action.
Understanding the physician-patient relationship
The physician-patient relationship exists directly between you and the treating physician, not ServMedica. ServMedica is a technology platform that facilitates connections but does not provide medical services directly.
Physicians on our platform are independent licensed professionals who exercise their own medical judgment. ServMedica does not control, direct, or influence medical decisions made by physicians.
Prescriptions are issued at the sole discretion of the treating physician. Not all consultations result in prescriptions. Physicians may decline to prescribe certain medications including but not limited to:
Financial terms and conditions
All prices displayed in USD unless otherwise stated
Consultation fees are charged at time of booking
Plan subscriptions are billed per trip/period purchased
Prices subject to change with 30-day notice
Taxes applied based on your location
All purchases are final and non-refundable once confirmed
No refunds for unused consultations, whether or not your trip occurs
Plan coverage is activated at purchase — not at first use
Documented technical failures preventing consultation delivery may qualify for a one-time service credit at ServMedica's discretion
Service credit requests must be submitted within 14 days of the incident
Chargebacks filed without first contacting support may result in account suspension
Important legal limitations
We are not liable for outcomes from physician recommendations, prescriptions, or medical decisions made during consultations.
We are not liable for service interruptions, technical failures, or connectivity issues beyond our reasonable control.
We are not responsible for pharmacies, laboratories, or other third-party providers you interact with.
Our total liability shall not exceed the amount you paid for services in the 12 months preceding any claim.
SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Some jurisdictions do not allow exclusion of implied warranties, so some of the above exclusions may not apply to you.
You agree to indemnify, defend, and hold harmless ServMedica, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, or expenses arising out of:
Any breach or violation of these Terms of Service by you or anyone using your account
Your use or misuse of the Services, including any medical decisions made based on consultations
Providing inaccurate, misleading, or fraudulent personal or medical information
Any infringement or violation of the rights of any third party, including other users or physicians
Violation of any applicable local, national, or international law or regulation
How disputes will be handled
Attempt to resolve disputes informally by contacting [email protected]
If unresolved after 30 days, parties agree to good-faith mediation
Final resolution through binding arbitration per ICC rules
YOU AND SERVMEDICA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.
Unless both you and ServMedica agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
We may terminate or suspend your account immediately, without prior notice, for any breach of these Terms. Upon termination, your right to use the Services ceases immediately.
Provisions that by their nature should survive termination shall survive, including ownership, disclaimers, and limitations of liability.
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.
These Terms, together with the Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and ServMedica concerning the Services and supersede all prior agreements and understandings.
The Services and all contents, features, and functionality are owned by ServMedica and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.
You may not copy, modify, distribute, sell, or lease any part of our Services without prior written consent. "ServMedica" and our logo are registered trademarks.
By using ServMedica's services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including the binding arbitration clause and class action waiver. You confirm that you meet all eligibility requirements and agree to comply with all user obligations outlined herein.
